The House of Representatives approved on Wednesday (21) the Bill 795/21, of the Senate, which reformulates the Aldir Blanc Law to extend the deadlines for the use of resources transferred as support to the cultural sector due to the Covid pandemic. -19. The matter will be referred to the presidential sanction.


The text allows states, Federal District and municipalities to use, until December 31, 2021, the remaining balance of money transferred to emergency income actions and cultural projects.


Likewise, They can again be transferred to municipalities resources that were returned to the state fund of culture because the prefectures did not use them in cultural projects.


In such a case, a new deadline (31 October 2021) is reopened for cities to apply the money for this purpose, otherwise they will have to return it to the fund.

What is not used in 2021 shall be returned by the Federative Entities to the Union by 10 January 2022. Already the accountability should take place until 30 June 2022 or 31 December 2022, according to the expenses incurred are with resources of exclusive responsibility of each state or municipality or with Union resources.


New projects The matter was approved with the assent of Mr Danilo Cabral (PSB-PE), who also recommended approval of drafting amendment of Mrs Jandira Feghali (Pcdob-RJ), rapporteur of the project by the Culture Commission.


Danilo Cabral recalled that despite enforcement difficulties, the law was a success.


"Even damaged especially by the delay in regulation and definition of the disbursement schedule established by the federal government, the Aldir Blanc Law contemplated 40 thousand draft notices only in the states and the Federal District", said the deputy in his report, read in plenary by Tadeu Alencar (PSB-PE).

The amendment allows municipalities to grant new monthly subsidies for the maintenance of artistic and cultural spaces and community cultural organizations, for example, provided that they have interrupted their activities by virtue of social isolation measures.


The redistributed resources may also serve for public calls to select, among others, artistic and cultural projects that can be transmitted by social networks and digital platforms.

Jandira Feghali pointed out that, in the House, there were 12 authors of projects whose contributions were taken to the Senate to build the text.


Approved projects The text also extends the deadline for the application of resources for cultural activities through projects approved before the pandemic. The deadline expires in June 2021 and will be extended to another year.


Maintenance The proposal defines one of the purposes of applying the resources transferred, the maintenance of artistic and cultural spaces, microenterprises and small cultural enterprises, cooperatives, institutions and community cultural organizations.

Thus, will be considered maintenance the general and usual expense from the beginning of the public calamity if related to recurrent services, transport, artistic and cultural activities, taxes, labor and social charges and other expenses proven by the cultural spaces.


Counterpart Regarding the counterpart that the beneficiaries of the law must submit to have access to resources, the approved project establishes a period of 180 days, counted from the resumption of their activities, for this to occur, considering the epidemiological situation-sanitary of each city and region.


One of the counterparts created by the project is the live presentation with popular interaction over the internet (Live Streaming).


Credit lines Another change is the increased shortage for borrowers with federal banks under the conditions laid down by the Aldir Blanc Law.


Instead of starting to pay at the beginning of July 2021, the instalments will be due from 1 July 2022.


Pronac The text extends for another year the deadlines for the capture and execution of all approved cultural projects under the National Programme for Support of Culture (PRONAC).


The activities included in the projects may only be carried out after the end of the restrictions determined by the health authorities. The law referred to the public calamity decree, which expired on 31 December 2020.


The accountability should be done in 180 days after the execution of the project.
